Terms & Conditions

1. Communication Boundaries

I am available for support Monday through Friday during business hours (9 am–5 pm EST). Response time for non-urgent messages is 1–2 business days. Sessions and primary communication will be conducted via Zoom, phone, or email as agreed.
Sunday is the Sabbath. Under any circumstances, I will not be available on Sundays in honor of the Lord.

2. Sabbath Observance

All services—coaching, mentorship, speaking, support calls—are unavailable on Sundays. No sessions, calls, emails, or communications will be scheduled or returned on this day.

3. Unlicensed Practice & Scope of Services

Toshia Amara provides faith-based encouragement, coaching, mentorship, and speaking services strictly for spiritual and personal development. These non-clinical services do not constitute professional counseling, therapy, diagnosis, or medical advice. I am not a licensed mental health provider, medical professional, or counselor in Ohio or any other jurisdiction. Under Ohio Revised Code § 4757.02 and § 4757.21, diagnosing or treating mental or emotional disorders requires a license. All services are faith-based and exempt from licensing requirements. Clients with clinical or crisis needs should seek qualified, licensed professionals.

4. Cancellation & Rescheduling

Clients may cancel or reschedule a session with at least 48 hours’ notice. One reschedule is permitted per session without penalty. Cancellations with less than 48 hours’ notice incur a 50% cancellation fee. No-shows or cancellations without communication forfeit the session fee. Repeated late cancellations may result in termination of services without refund.

5. Refund Policy

All coaching, mentorship, packages, and speaking fees are non-refundable. In rare, pre-approved cases, prorated refunds may be issued minus administrative fees. No refunds for missed or unused sessions. If I must cancel or reschedule, I will provide adequate notice and reschedule at no additional cost.

6. Payment Terms

Payments are due in full before the first session or speaking engagement. Accepted methods: PayPal, Stripe, and major credit/debit cards. Select services offer payment plans; failure to adhere may result in service suspension or fees.

7. Consumer Protection & E-Commerce Compliance

7.1 Ohio Consumer Sales Practices Act
All fees and merchandise sales comply with the Ohio Consumer Sales Practices Act (R.C. Chapter 1345). Services and products are offered in good faith, without deceptive or unconscionable practices.

7.2 FTC Testimonials & Affiliate Disclosures
Testimonials on this site reflect individual experiences; they do not guarantee similar outcomes. Per FTC 16 C.F.R. Part 255, any materials connection—complimentary services or affiliate commissions—is disclosed. Some links may be affiliate links; I earn a commission at no extra cost to you.

8. Privacy & Confidentiality

8.1 Confidentiality
All sessions and communications are confidential and sacred. Information will not be disclosed without written consent, except if required by law (e.g., imminent harm, court order).

8.2 Data Protection & Breach Notification
Personal data is stored securely. In case of a breach of unencrypted personal information, affected Ohio residents will be notified per Ohio Revised Code Chapter 1347.

8.3 Email & CAN-SPAM Compliance
By subscribing to newsletters, you consent to receive periodic emails. You may unsubscribe at any time via the link provided. We comply with the CAN-SPAM Act: clear subject lines, valid sender information, and an easy opt-out method.

8.4 Children’s Privacy & COPPA
This site is not directed to children under 13. We do not knowingly collect personal information from minors. If you believe we collected data from a child under 13, contact us immediately for deletion.

9. Intellectual Property

All coaching materials, workbooks, devotionals, presentations, recordings, and merchandise designs provided during coaching, mentorship, or speaking engagements are the exclusive intellectual property of Toshia Amara. You may not reproduce, distribute, modify, or create derivative works without prior written permission.

10. Limitation of Liability

To the fullest extent permitted by law, Toshia Amara, affiliates, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from coaching, mentorship, speaking engagements, use of materials, or website use—even if advised of the possibility of such damages. Your sole remedy is to discontinue use of services and materials.

11. Termination Clause

Clients may terminate services anytime with written notice. No refunds for completed sessions. I reserve the right to discontinue services for boundary breaches, disrespect, repeated cancellations, or misalignment of goals with no refund.

12. Governing Law & Dispute Resolution

This agreement is governed by Ohio law. Any dispute arising under or related to this agreement shall be resolved by binding arbitration in Franklin County, Ohio, under the rules of the American Arbitration Association. The arbitrator’s decision is final and may be entered into any court of competent jurisdiction.

13. Acknowledgment

By scheduling or attending any service—coaching, mentorship, speaking engagements—or purchasing any product, you acknowledge that you have read, understood, and agree to these Terms & Conditions in full. Let us walk this journey with grace, honor, and commitment to wholeness.

1. Non-Clinical, Faith-Based Support

Toshia Amara offers faith-based encouragement, support calls, mentorship, and wellness guidance rooted in spiritual principles. These services are strictly non-clinical and are not a substitute for licensed professional counseling, therapy, addiction treatment, or medical advice.

2. Unlicensed Practice of Counseling

Toshia Amara is not a licensed mental health provider, medical professional, or counselor in Ohio or any other jurisdiction. Under Ohio Revised Code § 4757.02 and § 4757.21, “professional counseling” and “treating mental or emotional disorders” require a license. All services provided by Toshia Amara are faith-based, exempt from these licensing requirements, and intended for personal and spiritual growth only. 3. Voluntary Participation & No Guarantees

Participation in any mentorship, coaching, prayer, or support service is entirely voluntary. No specific results, outcomes, or guarantees are promised. Individual experiences vary, and spiritual or emotional breakthroughs depend upon each person’s beliefs, efforts, and personal circumstances.

4. Emergency & Crisis Resources

If you are facing a medical or mental health emergency, please contact 9-1-1 or your nearest emergency services. For immediate mental health support, dial 988 (Suicide & Crisis Lifeline) or seek licensed care.

5. Consumer Protection & FTC Compliance

5.1 Endorsements & Testimonials
Any testimonials or endorsements appearing on this site reflect real clients’ experiences but are not guarantees of similar outcomes. Under FTC’s 16 C.F.R. Part 255, material connections (e.g., complimentary services, affiliate payments) are clearly disclosed.

5.2 Affiliate Disclosures
Some links on this site may be affiliate links. If you click an affiliate link and make a purchase, Toshia Amara may earn a commission at no additional cost to you. These relationships are disclosed where they occur.

6. E-commerce Terms (Merchandise & Digital Products)

6.1 Sales & Returns
All merchandise and digital products sold through this site are subject to the Ohio Consumer Sales Practices Act (R.C. Chapter 1345) and applicable federal e-commerce regulations. Unless otherwise stated, you have 14 days from receipt of physical goods or download of digital products to request a full refund. Returns must be unused, in original packaging (if applicable), and accompanied by proof of purchase.

Products and merchandise are offered “as-is” and without warranties of any kind, express or implied, except as required under Ohio law. To the fullest extent permitted by law, Toshia Amara disclaims all warranties, including merchantability and fitness for a particular purpose.
